Home invasions in Queensland now have become so frequent many are not reported in the media. Home owners in Queensland have almost no protection from knife-wielding offenders who have scant regard for law.
Home owners have been murdered or left seriously injured and should they try to defend themselves by any means they face prosecution by over-zealous police.
Offenders have more rights than occupants should they try to defend themselves with a weapon, be it a cricket bat or firearm and should an invader get injured, the police in line with precedents, would charge the occupant for violence, despite Common Law allowing a right of self defence.
Admiralty courts ignore Common Law.
KAP Member for Hinchinbrook Nick Dametto has championed Castle Law and firmly believes homeowners should be able to defend themselves without any legal recriminations.
The United States allows self defence particularly for home invasions where criminals are often incapacitated by any means after threatening or carrying out violence.
In 2012 a young Oklahoma girl shot an intruder who broke into her home while alone believing he was going to rape her.
She was given a citation by the local sheriff.
